General Terms and Conditions (Terms)

This English translation is provided for convenience. The German version is legally binding.

Section 1 Scope

1. These Terms apply to all contracts relating to the use of the indoor surf facility (citywave®), the associated dining, outdoor and adjacent areas, as well as to all online bookings and purchases made via wellenwerk-berlin.de.
2. Any deviating or supplementary terms of the customer only apply if Wellenwerk expressly agrees to them in text form.
3. The current version at any given time also applies to future contractual relationships with the same customer.

Section 2 Formation of contract

1. Product and service descriptions do not constitute a binding offer.
2. By completing the order process, the customer submits a binding offer; the contract is formed once the electronic order confirmation is received.
3. Contract documents (order confirmation, invoice, Terms) are provided in text form and stored electronically.
4. The language of the contract is German.

Section 3 Scope of services

Wellenwerk offers, among other things, the following products and services:

  • Surf tickets (individual sessions)
  • Exclusive sessions (privately booked, closed surf slots)
  • Multi-session passes (5 to 100 sessions)
  • Annual passes (Blue / Gold)
  • (Gift) vouchers (surf, value, dining, experience)
  • Merchandise items

Delivery of services is subject to technical and organizational availability. There is no entitlement to specific times, coaches, or group sizes.

Section 4 Participation requirements

1. Persons aged 6 and up are eligible to participate. A minimum weight of 28 kg and the “Seepferdchen” swimming badge are recommended.
2. Children under 15 must wear a suitable helmet during their surf time.
3. Minors require written consent from a parent or legal guardian.
4. The following are excluded from participation: persons with health conditions (e.g., cardiovascular, back or joint issues), acute injuries, open wounds, contagious diseases, pregnant persons, and persons under the influence of alcohol or drugs.
5. Wellenwerk staff are entitled to exclude participants from use if they pose a recognizable risk to themselves or others.

Section 5 Availability and cancellation by Wellenwerk

1. Sessions are subject to technical, organizational and safety-related reservations.
2. Wellenwerk is entitled to cancel or postpone sessions if a) maintenance, safety or regulatory measures require it, b) weather or force majeure prevents it from taking place, or c) fewer than 6 participants are registered by no later than 12 hours before the start.
3. In the event of a cancellation, tickets and vouchers remain valid. Claims for refunds or damages exist only in cases of intent or gross negligence on Wellenwerk’s part.

Section 6 Rebooking and cancellation by the customer

1. Regular bookings can be rebooked via the customer portal up to 72 hours before the start.
2. In the case of documented illness, rebooking is also possible within this period upon presentation of a medical certificate.
3. Exclusive surf sessions: a) Free withdrawal and cancellation within 14 days of purchase, provided the booked date does not fall within this period. b) If the date falls within the 14-day period, cancellation is excluded; a one-time, free rebooking is possible up to 72 hours before the start at the latest. c) As a general rule, exclusive sessions can be postponed free of charge up to 14 days before the originally booked date. d) After these deadlines have passed, cancellations or rebookings are excluded.

Section 7 Rental equipment, care and compensation for damage

1. For the duration of the session, Wellenwerk may provide rental equipment (surfboard, wetsuit, lycra suit, helmet). Personal equipment may only be used with staff approval.
2. The customer must handle rental equipment with care and report any damage immediately.
3. In the event of loss or damage, a flat replacement fee of €200 is charged. The customer may prove that the damage was lower, and Wellenwerk may prove that it was higher.

Section 8 Liability and personal responsibility

1. Use of the citywave® is at the participant’s own risk. Participants acknowledge that sporting activity carries an increased risk of injury, particularly in the event of negligent or improper behavior.
2. Liability on the part of Wellenwerk, Action Team Veranstaltungs GmbH and their subcontractors is excluded unless damages are caused by intent or gross negligence.
3. In cases of ordinary negligence, Wellenwerk is only liable for breaches of material contractual obligations (cardinal obligations), and then limited to foreseeable damages typical for this type of contract.
4. Liability for injury to life, body or health, as well as any mandatory statutory liability (e.g., product liability), remains unaffected.
5. Valuables brought along are not looked after; bringing them is at the owner’s own risk.

Section 9 (Gift) vouchers

1. Vouchers can be redeemed for three years from the end of the year of purchase.
2. Value and experience vouchers are transferable; annual passes are tied to a specific person.
3. Cash payout, even partial, is excluded. Any remaining balance is retained until the deadline expires.

Section 10 Prices and payment

1. All prices are final prices including statutory VAT.
2. Payment methods: debit or credit card on site, as well as online payments via Stripe, PayPal, Sofortüberweisung or bank transfer.
3. Retention of title applies until payment is made in full.

Section 11 Rules of conduct and house rules

1. Entry and participation are prohibited while under the influence of alcohol or drugs.
2. Food and drinks brought from outside may not be consumed anywhere on the premises.
3. Animals are not permitted in the surf area.
4. Staff instructions must be followed.
5. Wellenwerk exercises its house rules; a ban from the premises may be issued in the event of violations. No claims for refunds exist in such cases.

Section 12 Photo, audio and video recordings (Surf Eye)

1. During sessions, automatic video recording is carried out by Surf Eye to create personalized surf videos (https://wellenwerk.surfeye.video).
2. Legal bases: Art. 6(1)(b) GDPR (performance of contract) for providing the personal clips, and Art. 6(1)(a) GDPR (consent) for marketing purposes.
3. Use for marketing purposes (website, social media, etc.) only takes place with consent; withdrawal or objection is possible at any time by emailing Surf Eye or Wellenwerk.
4. For private bookings, consent generally applies to all participants unless an individual objection is raised.
5. Recordings are stored securely and automatically deleted after 30 days unless purchased.

Section 13 Data protection

Personal data is processed exclusively in accordance with the GDPR and the privacy information published on the website.

Section 14 Video surveillance (security areas)

Selected areas (entrance, parking lot, surf area) are monitored by video surveillance; the purpose is to protect people, facilities and property. The surveillance is clearly signposted.

Section 15 Changes to these Terms

Wellenwerk may amend these Terms to the extent required for legal, technical or organizational reasons, provided the changes do not unreasonably disadvantage the customer. The current version at wellenwerk-berlin.de is authoritative.

Section 16 Events and special bookings

1. Events, group bookings, company parties, exclusive events and special dining events at Wellenwerk (referred to below as “Events”) are calculated individually and confirmed separately by contract.
2. An Event is only considered bindingly booked once Wellenwerk has issued written order confirmation.
3. A deposit of 50% of the calculated order total is due no later than 30 days before the service is provided. The remaining balance is payable after the Event based on the invoice.
4. Withdrawal from the contract is only possible for good cause.
5. If the client withdraws from the contract without good cause, the following cancellation terms apply:

  • up to 4 weeks before the Event: 50% of the quoted price
  • 4 weeks to 5 days before the Event: 70% of the quoted price
  • 5 days before up to the day of the Event: 100% of the quoted price

6. The relevant factor is when the written notice of withdrawal is received (email is sufficient).
7. Any payments already made are offset against the cancellation costs; there is no entitlement to a refund beyond this.
8. Wellenwerk is entitled to withdraw from the contract for good cause (e.g., regulatory requirements, safety reasons, force majeure); in this case, any amounts already paid will be refunded in full, and no further claims exist.

Section 17 Place of jurisdiction and applicable law

1. The place of performance and, to the extent permitted, the place of jurisdiction is Berlin.
2. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
